Qld: D'Arcy trial aborted
A judge has aborted former Queensland Labor Party MP BILL D'ARCY'S third child sex
trial, and he's urged the prosecution to reconsider whether they should continue with
the case.
Brisbane District Court Judge KERRY O'BRIEN aborted the trial after the prosecution
dropped three of 12 charges against D'ARCY.
Judge O'BRIEN says the fact the statements taken by the four complainants were made
more than five years ago about events that happened 40 years ago played a significant
role in their evidence at trial.
He's added that even if there's a future conviction on the nine charges, it may not
eventuate in a significant increase in the sentence D'ARCY is already serving.
The prosecution dropped the three charges after conceding there's not enough evidence
to substantiate two of them, while the third wasn't proceeded with after a legal ruling
by Judge O'BRIEN.
D'ARCY is already serving a total of 10 years and six months in jail, following convictions
in two earlier child sex trials.
